RESERVES SERVICES/COPYRIGHT GUIDELINES

The library complies with the Copyright Laws of the United States, while it also utilizes the Fair Use provisions addressing the needs of scholars and students.

Copyright permission for photocopies

Upon the request of a faculty member, the library accepts for reserve any copy of a chapter, article, short story, graph, chart, picture, cartoon, poem, or short essay provided the author or artistic originator is identified, along with the title and date of publication from which the item was found.  The primary responsibility of securing copyright clearance rests with the faculty, however the library will assist with the process.  The material can be placed on reserve for up to one semester while the application process is taking place.  Denial of copyright clearance will result in the item’s immediate removal from the reserve collection, and return to the faculty member.

 

Copyright Clearance Center 

       If the faculty member is unable to get permission from the publisher, the library will     
       pursue obtaining clearance through the Copyright Clearance Center.  The process may
       require some time for copyright clearance. Material needed for more than one semester
       will require permission each time that material is submitted.  If permission cannot be
       given through the service, the library will inform the faculty member, and assist in
       alternate clearance inquiries.  Any material denied permission must be removed from the
       reserve collection and will be returned to the faculty member. 

 

Number of copies 

Faculty may place on reserve one photocopy for every 10 students in a class.

           

Ownership

       All materials submitted are the property of the faculty member, who is the ultimate person
       responsible for complying with the Copyright Act.

  • The library stamps all materials with a notice of possible copyright protection as a warning to the user. 

  • The library returns material to the faculty at the end of the semester.

 

Material that cannot be placed on reserve

       Because of copyright restriction the library cannot accept for reserve copies of a
       copyrighted workbook, test or test booklet, answer sheet, or coursepack.  Books
       borrowed from another library may not be placed on reserve.  ACTS institutions may loan
       books among themselves for reserve status in come limited circumstances.
